Should I fight my ticket for cvc23111?
I was given a ticket today by the CHP for cvc2311 for "ashing" my cigarette out of my window. I did not throw the whole cigarette only a flick of ash.
cvc 23111 States "No person in any vehicle and no pedestrian shall throw or discharge from or upon any road or highway or adjoining area, public or private, any lighted or nonlighted cigarette, cigar, match, or any flaming or glowing substance.
From my firefighting experience ash is a something that has reached 100% combustion and is no longer burning.
Dictionary.com defines ash as "the powdery residue of matter that remains after burning." Key words being "after burning"
Do I have a chance at fighting this?

Go ahead and try. The amount may be reduced or the officer may not show up. But you realize by flicking the cigarette, any lighted part could blow into the wind and start a fire on the side of the road. If you are a smoker, be a responsible one. Use your ashtray at all times. Don't put our earth or lives in danger because of a fire started by human negligence.
